1. Acceptance of Terms
By registering for, accessing, or using Toocak, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform.
2. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach.
3. Merchant Content & Prohibited Products
As a store owner, you represent and warrant that you own or have obtained all necessary rights to any content, trademarks, images, and product descriptions published on your storefront. You strictly agree not to use the platform to sell, promote, or facilitate transactions for:
- Child Sexual Exploitation & Abuse Material: Any material, depiction, or content involving child sexual exploitation, abuse, or harm. Toocak enforces an absolute zero-tolerance policy, terminates accounts immediately, and reports violations directly to law enforcement authorities.
- Pornography & Adult Content: Pornography, sexually explicit content, adult novelty goods, erotic entertainment, or non-consensual sexual media.
- Alcohol & Alcoholic Beverages: Alcoholic beverages, liquor, beer, wine, spirits, or any intoxicating drinks.
- Gambling & Betting Services: Gambling activities, sports betting, lottery tickets, casino games, raffles, games of chance, or gambling equipment.
- Dangerous Weapons & Explosives: Firearms, firearm parts, ammunition, explosives, fireworks, combat or tactical knives, dangerous blades, or any weapons and tactical gear.
- Illegal Goods & Narcotics: Illegal substances, narcotics, prescription drugs without authorized distribution, or controlled substances.
- Counterfeit or Stolen Goods: Counterfeit, infringing, replicated, or stolen merchandise.
- Deceptive & Fraudulent Schemes: Misleading, scam, fraudulent schemes, or deceptive business practices.
- Harmful or Violent Material: Content or products that promote violence, harassment, hate speech, self-harm, or unlawful discrimination.
Toocak reserves the right to immediately suspend or terminate any storefront or account found to violate these standards without prior notice.
4. Transactions & Customer Relations
Toocak facilitates the presentation of your catalog and the formatting of customer inquiries into WhatsApp messages. Any sale, agreement, pricing negotiation, fulfillment, or dispute resolution occurs directly between you and your customer. We are not a party to the transactions between merchants and buyers.
5. WhatsApp & Meta Platform Compliance
Merchants using our WhatsApp ordering or WhatsApp Flows features must strictly comply with the WhatsApp Business Policy and WhatsApp Commerce Policy established by Meta Platforms, Inc.
Merchants may not use WhatsApp integration features to distribute unsolicited spam messages, harassment, fraudulent schemes, or commercial offerings that violate Meta's terms. Failure to comply may result in immediate suspension of WhatsApp checkout integration.
6. Service Availability & Intellectual Property
We strive for maximum platform uptime and reliability, but do not warrant that service will be uninterrupted or error-free. The Toocak brand, logo, template engine, and underlying software remain the exclusive intellectual property of Toocak.
7. Termination & Account Deletion
You may terminate and delete your account at any time via your dashboard under Account Settings (/profile) or by requesting closure through our support team.
30-Day Cooling-Off Period & Restoration: When an account deletion is initiated by you, your published storefronts and connected services are immediately suspended into maintenance mode to safeguard customers. Your account enters a 30-day grace period during which you retain the ability to cancel the deletion and restore your account and stores simply by logging back in.
Final Deletion: After 30 consecutive days, your right to self-restore expires. Toocak reserves the right to permanently purge your account records, user profile, and storefront data. Platform administrators retain discretion to restore or permanently erase data upon verified requests.
Termination by Toocak: We reserve the right to immediately suspend or permanently terminate any storefront or user account found to breach prohibited content rules, Meta platform policies, fraudulent conduct, or these Terms without prior liability or notice.
